Gridiron Terms & Conditions
Registration for any of our locations creates a legal agreement (“Agreement”) between you, as parent or legal guardian (“Parent/Guardian”) of the child identified (“Child”) and Flag Holdings, LLC (dba Gridiron Football, together with its, affiliates, partners, subsidiaries and employees, “Gridiron”). Parent/Guardian hereby grants the Child permission to participate in Gridiron activities. BY CHECKING THE BOX ON THE SIGN UP PAGE, OR BY REGISTERING WITH THE SITE, PARENT/GUARDIAN AGREES TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT. If Parent/ Guardian does not agree to the terms of this Agreement, do not check the box and do not use or access https://www.Gridironfb.com (“Gridironfb.com”), as well as Gridiron’s social media websites, mobile websites, applications and other content (collectively, the “Service”).
The Service is offered to the Parent/Guardian conditioned upon acceptance without modification of this Agreement. Parent/Guardian acknowledges that, from time to time, it may be necessary for Gridiron to update or revise certain provisions of the Agreement. By accepting this Agreement, Parent/Guardian agrees that Gridiron may change the terms of the Agreement in its sole discretion without notice. If Parent/Guardian does not agree to the changes proposed by Gridiron, or to any terms in this Agreement, Parent/Guardian’s sole and exclusive remedy is to cancel the Gridironfb.com account (“Parent/Guardian’s Account”). Notwithstanding the foregoing, Gridiron reserves the right to cancel, suspend or refuse access to the Gridiron website or related services to anyone in its sole discretion. Unless explicitly stated otherwise, any new features or products that change, augment or enhance the current Service shall be subject to this Agreement.
Parent/Guardian shall not use the Service, in whole or in part, for any purpose that is unlawful or prohibited by this Agreement. Gridiron may, from time to time, conduct a promotion or contest; by participating in any manner in any such promotion or contest, Parent/Guardian agree to comply with the terms and/or rules of any such promotion or contest, this Agreement, Gridiron’s Privacy Policy and any other applicable terms.
This section provides all users of the Gridiron website and those registering and/or receiving services from Gridiron with the governing Gridiron Terms of Service and Conditions, Gridiron’s Privacy Policy and all other required Waivers and Policies governing the Gridiron website and services. Gridiron requires all Parents/Guardians registering their Child with the intention to receive Gridiron services to read and agree to all the Gridiron’s Terms of Service and Conditions, Gridiron’s Privacy Policy and all other Waivers and Policies included in this section as an express condition of registration.
GRIDIRON MEDICAL LIABILITY WAIVER
In consideration of my Child being allowed to participate in any way in Gridiron’s programs, related events and activities, Parent/Guardian acknowledge, appreciate, and agree that the risks of injury and illness (ex: communicable diseases such as MRSA, influenza, and COVID-19) to the Child from the activities involved in these programs are significant, including the potential for permanent disability and death, and while particular rules, equipment, and personal discipline may reduce these risks, the risks of serious injury and illness do exist; and Parent/Guardian agree as follows:
PARENT/GUARDIAN AND CHILD KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASES (as defined herein) or others, and assume full responsibility for the Child’s participation;
PARENT/GUARDIAN AND CHILD knowingly and willingly agree to comply with and agree to the Gridiron Football Terms of Service and Conditions. If Parent/Guardian observe any unusual significant concern in the Child’s readiness for participation and/or in the program itself, Parent/Guardian will remove the Child from the participation and bring such attention of the nearest Gridiron official immediately;
PARENT/GUARDIAN AND CHILD KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS of the Child contracting and/or carrying a communicable disease such as MRSA, influenza, and COVID-19 and that the risks association with a communicable disease are dangerous, including the potential for permanent disability and death. While particular rules, equipment, and personal discipline may reduce these risks, the risks of serious illness exists;
PARENT/GUARDIAN AND CHILD and on behalf of their heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS Gridiron; its directors, officers, officials, agents, employees, volunteers, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“Releasees”), WITH RESPECT TO ANY AND ALL INJURY, ILLNESS, DISABILITY, DEATH, or loss or damage to person or property incident to the Child’s involvement or participation in Gridiron programs, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law;
PARENT/GUARDIAN AND CHILD on behalf of their heirs, assigns, personal representatives and next of kin, HEREBY INDEMNIFY AND HOLD HARMLESS all the above Releasees from any and all liabilities incident to the Child’s involvement or participation in these programs, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent permitted by law. Parents/Guardians and Child promise not to sue Gridiron nor its directors, officers, officials, agents, employees, volunteers, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct events; and
The Parent/Guardian, assert that I have explained to my Child: the risks of the activity, his/her responsibilities for adhering to the rules and regulations, and that my Child understands this agreement.
GRIDIRON REGISTRATION REFUND POLICY
Parents/Guardians are encouraged to purchase Registration Protection during the Registration process if they have any concerns about their Child’s participation in Gridiron’s programs.
GENERAL REFUND POLICY
- Full refunds are available up until teams are formed. Teams are formed 4 weeks before the first game of the season. (Select markets may have a different refund policy. Check with your local operator to inquire about their refund policy leading up to a season).
- 50% refunds will be offered after teams are formed and uniforms have been ordered. Uniforms are ordered starting 21- 28 days before the first games.
- Registration Protection- This protection will provide the opportunity for a full refund, no questions asked, up until the first day of games being played.
- No refunds after the first game has been played.
In the event of extenuating circumstances, registration refunds may be considered upon a written request from a Parent/Guardian. Examples of extenuating circumstances may include a Child’s injury, family relocation to a new region, or family hardship. In the event of an extenuating circumstance, please contact your local operator for further direction. The amount refunded, if any, will be solely determined by Gridiron.
Gridiron programs require a minimum commitment of two hours per week on a Friday, Saturday or Sunday depending on the respective league during the scheduled season. Parents/Guardians that are unwilling or unable to allow the Child to make the weekly time commitment will not receive any refunds or future credits for missed practices or games.
GRIDIRON FORCE MAJEURE CANCELATION POLICY
Gridiron shall not be liable or responsible for registration refunds for failure, cancellation, suspension, postponement, delay, or shortening in services resulting from a Force Majeure Event, inclusive of causes beyond it’s reasonable control, including, but not limited to: acts of God; field closures; labor disputes; war; terrorism; riot; acts of civil or military authorities; epidemics; pandemics, specifically COVID-19 and related viruses; floods; fires; unusual severe weather conditions; accidents; or other contingencies the non-occurrence of which was a basic assumption on which the registration was made.
A delay caused by Force Majeure shall not be deemed a cancellation of the season or termination of this Agreement unless Gridiron, in its sole discretion, provides you written notice stating otherwise (the “Cancellation Notice”). The time for performance of Gridiron’s obligations may be amended for the period of delay or inability to perform due to such Force Majeure, as determined in the sole and absolute discretion of Gridiron.
Gridiron shall not be liable or responsible for refunds for failure, cancellation, suspension, postponement, delay, or shortening in services resulting from a federal, state, county, city or government agency mandate, order or policy directive that will not allow Gridiron services to be provided due.
Gridiron, at its sole discretion, may grant a Child a non-transferable registration credit of an amount solely determined by Gridiron for a future season and such credit would expire 12 months following issuance.
GRIDIRON GAME MAKE-UP POLICY
Gridiron will provide for one make-up game per season related to games cancelled as a result of inclement weather or other reasons. This policy does not relate to a game or games that maybe cancelled by a coach. Should multiple cancellations occur within the season, Gridiron shall have the option to create double headers and modify the season schedule to accommodate make-up games. Since there are certain situations beyond Gridiron’s control, Gridiron will do its very best but is not obligated to make up games that are canceled, due to several factors that are out of Gridiron’s control the reschedules are not always possible.
GRIDIRON JERSEY AND EQUIPMENT RETURNS AND EXCHANGE POLICY
Gridiron is responsible for delivery of jerseys and other equipment based upon the quantity and sizes ordered during the Gridiron registration process. In the event Gridiron ships the wrong size, quantity or item it is Gridiron’s responsibility to rectify the error at Gridiron’s expense. In the event a Parent/Guardian orders the incorrect size or quantity of a jersey or equipment, Gridiron has a no return or exchange policy due to COVID protocol issues. In the event a Parent/Guardian misspells the Child’s name on a personalized jersey when ordered, a replacement jersey maybe ordered at the Parent/Guardian’s expense. If a Parent/Guardian fails to return rental equipment within 15 calendar days of the final game of a season, Gridiron will retain 100% of the deposit related to equipment not returned. All questions related to the Gridiron jersey, and equipment returns equipment deposit. All questions related to the Gridiron Jersey and Equipment Returns and Exchange policy should be directed to the Gridiron’s Customer Success team at support@gridironfb.com.
GRIDIRON PERSONAL INFORMATION POLICY
Personal Information will not be sold by our company. Personal information will be shared for team related purposes (team rosters, practices and carpooling) and consistent with the Gridiron Privacy Policy which is incorporated herein by reference.
GRIDIRON PHOTOGRAPHY, VIDEO, SOCIAL MEDIA AND MULTIMEDIA POLICY
In consideration of the Child being allowed to participate in any way in Gridiron’s programs, the Parent/Guardian hereby grant Gridiron permission and license to use, print, publish, broadcast, video stream or post in Gridiron related newsletters, brochures, websites or other media the photographs, video, audio or other materials in which the Child may have appeared, spoken, written or otherwise participated. Parent/Guardian hereby authorize representatives of Gridiron to use any of this Material without notice, obtaining additional consent or providing additional consideration. This Photography, Video, Social Media and Multimedia Policy will be applied in conjunction with and consistent with the Gridiron Privacy Policy.
CHILDREN’S ONLINE PRIVACY PROTECTION ACT (COPPA)
The primary goal of COPPA is to place Parents/Guardians in control over what information is collected from their children online. COPPA is designed to protect children under age 13, while accounting for the dynamic nature of the Internet. Gridiron does not knowingly collect information from children under the age of 13. Furthermore, Gridiron does not target its products and services to children under these ages nor do we knowingly communicate with children under 13. When we work with teams and groups with children under 13, the Parents/Guardians of the children are responsible for entering and managing their child’s information.
GRIDIRON FALSE REGISTRATION INFORMATION POLICY
Gridiron relies upon the integrity and accuracy of registration information when assigning teams. If the Parent/Guardian knowingly and purposefully submit false registration information about the Child, the Child will be removed from the Gridiron program with absolutely no refund or credit being provided. Gridiron may request and you agree to provide proof of school, grade, or age. Failure to provide requested proof of school, grade, or age, may also result in the Child’s removal from this program with no refund at Gridiron’s sole discretion.
GRIDIRON PARENTAL RULES AND GUIDELINES
Gridiron seeks to instill positive character-building traits in Children through the demonstration of good sportsmanship, respect for others, responsibility, fairness, caring and good citizenship. We ask that Parents/Guardians and their guests attending Gridiron sponsored events help us by reflecting these character traits at games.
